1. INTRODUCTION

1.1. In accordance with the Telecommunications and Information Technology Law (the Law), its Bylaw, the Communications, Space and Technology Commission (CST) Regulations, and the powers it includes for the CST, including those related to the regulation of telecommunication services, and in accordance with the development of telecommunications markets in the Kingdom and the best practices of other countries; CST issues the Regulation for Registration of Telecommunication Space Stations document for the purpose of registering telecommunication space station capacity providers.

2. DEFINITIONS

The words and expressions defined in the Telecommunications and Information Technology Act, the bylaw and other CST regulations shall have the same meaning when used in this regulatory document. The following words and expressions will have the meanings associated with them, unless indicated otherwise:

2.1. Non-Terrestrial Network (NTN): the interconnection system that includes space telecommunications stations and/or air-borne telecommunications stations, and may include ground devices and equipment associated with it, and used for telecommunications purposes.

2.2. Airborne non-terrestrial network: a network, or segment of a network, that uses an airborne object located between (1) and (80) kilometers of altitude at a specified, to payload the base stations or Subscriber's terminal station

2.3. Spaceborne non-terrestrial network: a network, or segment of a network, that uses telecommunication space station.

2.4. Telecommunication space station capacity: the capacity of the transmitter provided by the telecommunication space station.

2.5. Telecommunication space station capacity provider: the entity that operates the satellite, as identified in the filing submitted to the International Telecommunication Union (ITU), and capable of providing the telecommunication space station capacity over the Kingdom of Saudi Arabia.

2.6. Registry: the process of registering the data of telecommunication space station capacity provider and all their technical details to CST.

3. SCOPE OF THE DOCUMENT

3.1. This document applies to all telecommunication space station providers who provide their capacity over the Kingdom of Saudi Arabia, including the areas comprising the land, internal waters, territorial sea and zones over which the Kingdom exercises sovereignty and jurisdiction in accordance with international law, and the airspace above them.

4. SCOPE OF THE REGISTRATION AND ASSOCIATED TERMS AND CONDITIONS

4.1. Any telecommunication space station capacity provider who is providing satellite capacity over the Kingdom must register with CST as a registered telecommunication space station capacity provider.

4.2. Registered telecommunication space station capacity providers may only provide their capacity to the holders of “provision of operation service of NTN telecommunication networks” permit, or any other service provider who holds a license or other permit to provide such services in the Kingdom.

4.3. This registration does not grant the right to provide telecommunication services over NTN or provide operation services of NTN telecommunication networks; the necessary permits must be obtained.

5. REGISTRATION REQUIREMENTS

5.1. Submit the application through CST website.

5.2. Provide a brief description of the company profile and operations.

5.3. Provide a description of the capacities to be provided in the Kingdom, including total capacity provided.

5.4. Indicate the coordination details and technical specifications of the telecommunication space station as indicated in the online form available at the CST website.

5.5. All required documents and information shall be provided in Arabic. Any supporting documents (if any) may be submitted in English.

6. REGISTRATION PROCEDURE

6.1. Upon submission of the application, CST may request further clarification on the submitted information and documentation, depending on the nature of the telecommunication space station network.

6.2. CST shall suspend the registration application in the event that the required clarifications and supporting documents are not provided.

6.3. Within the (30) thirty working days following the application submission or the submission of the required clarifications, CST will either incorporate the applicant in the registry, if all requirements are met, or issue a decision denying the incorporation.

6.4. A list of registered foreign satellite capacity providers will be published on CST website.

6.5. All registered telecommunication space station capacity providers shall notify to CST any change on the information provided in the application process within the next (15) fifteen days of the change.

7. FEES

7.1. The incorporation on the registry and updating any information is free of charges or fees.

8. DURATION OF THE REGISTRY

8.1. The registry is not limited by a specific duration. However, all registered telecommunication space station capacity providers must update the registry in case of any amendments or upon CST request, and must notify CST if the telecommunication space station is replaced or its lifespan is expired.

9. GENERAL PROVISIONS

9.1. Approval of the registration application is subject to the sole discretion of CST.

9.2. CST reserves the right to cancel or suspend the registration if the required information is not provided or if there is a failure to comply with CST’s regulations. CST will notify the telecommunication space station providers if such action is taken.

9.3. This document is subject to periodic review by CST, and will be updated as it deems appropriate in accordance with the regulatory framework, and prior approval of the Governor of CST.
