ProjTitle.icon 9. TRANSITIONAL PROVISIONS

9.1.        The Regulations for Provisioning of Operation Services of NTN (this document) will replace and substitute the current relevant regulations.

9.2.        The Authorizations granted to General Class Licensees will remain as is and will not be altered till the expiry date of their General Class Licenses. Subsequent renewals will be subject to Network Permit Regulations.
9.3.        The current licensee will have the option to voluntarily migrate to the Provisioning of Operation Services of NTN Permit before the expiry of their General Class License.
9.4.        The obligations, general and special terms and conditions as stipulated in the current Authorizations’ regime under the General Class License shall remain the same and applicable to existing licensees.
9.5.        Any new application received by the CITC for General Class License will be subject to this regulatory document.

9.6.        Current Authorized providers of GMSPC systems and networks shall:
9.6.1.   Use international gateways of the licensed providers in the Kingdom to provide Internet access services.
9.6.2.   Establish the necessary technical means and procedures for monitoring and reporting on system performance and service quality.

9.7.        Current Authorized providers of VSAT systems shall:
9.7.1.   Locate a gateway station(s) inside the Kingdom, which can also be used to provide services outside the Kingdom with the required licenses and authorizations/licenses applicable on the foreign jurisdictions.

9.8.        Current Authorized providers of broadband satellite services shall:
9.8.1.   The use of the frequencies assigned to this service as designated by the CITC and according to the terms and conditions in the Spectrum License. Frequencies to be used shall be in accordance with the CITC National Frequency Plan as well as relevant Radio Spectrum Regulations.
9.8.2.   Build and/or operate the following facilities within the borders of the Kingdom of Saudi Arabia:
9​.8.2.1.       One or more gateway stations to secure the connection between these stations and one or more satellites with the terminal devices to manage the authorized services.
9.8.2.2.       A network operation center to provide services, support and control over the authorized services.
9.8.3.   Technical and interface equipment that enables the authorized person to abide by the following:
9.8.3.1.       Meet all technical requirements with which technical monitoring devices can be connected.
9.8.3.2.       Nomination of the ended subscribers’ traffic on the Internet in accordance with the CITC's regulations.
9.8.4.   Comply with all frequency spectrum coordination requirements issued and approved by the CITC when building or operating a main ground station or using subscriber terminal equipment whose technical characteristics or location require frequency spectrum coordination
9.8.5.   Ensure that the outgoing or ending traffic from international telecommunication networks takes place through the networks of service providers licensed to do so in the Kingdom, with no international traffic allowed to bypass those networks.

1.9.      Current Authorized Operators of connectivity systems on aircrafts (airborne or spaceborne) shall:
9.9.1.   The use of the frequencies assigned to this service as designated by the CITC and according to the terms and conditions in the Spectrum License. Frequencies to be used shall be in accordance with the CITC National Frequency Plan as well as relevant Radio Spectrum Regulations.
9.9.2.   Comply with all technic​al parameters and conditions contained in ITU recommendations for the use of mobile earth stations.
9.9.3.   Comply with any applicable Laws, regulations, guidelines that are imposed by other regulatory authorities in the Kingdom such as GACA.
9.9.4.   Comply with ITU and 3GPP standardized band plans and ITU regulations as well as any technical parameters specified by the ICAO.
9.9.5.   Comply with any limitations on the altitude of the aircraft, if any, to provide connectivity.
9.9.6.   Operation of connectivity systems of earth stations that operate on board foreign registered aircrafts and are not used to provide services outside the respective aircraft do not require a license while crossing the territory of the Kingdom and may not operate while on the Kingdom airports or below the maximum permitted altitude.      ​​​
